CabinetCare — 90 Day Performance Package — Partner Agreement
1. Services. CabinetCare provides, per enrolled kitchen: a 90 Day Precision Service visit ~90 days after installation (inspection & adjustment of doors, drawers, hinges, soft-close, hardware, panels, kickboards) with a photo report; a review request shown to the customer at the visit (on-screen prompt and QR code) linking to the Partner’s Google review page; marketing content (blog, Instagram, Facebook, Houzz, website) per clause 10; and a monthly report. Aftermarket work is quoted separately.
2. Enrolment. Kitchens are enrolled by adding the Package to the customer quote and providing details; each is confirmed by the Partner’s in-portal per-job confirmation, which is separate from this one-time acceptance.
3. Fees. $350 (AUD, excl. GST if applicable) per completed service, invoiced monthly, payable within 14 days. Overdue accounts may be suspended and charged interest under the Penalty Interest Rates Act 1983 (NSW).
4. Trial. First two enrolled kitchens are no-lock-in; either party may end the trial without penalty.
5. Term. Commences on acceptance; terminable on 30 days’ notice, or immediately for unremedied material breach or insolvency. Completed-service fees remain payable.
6. Exclusivity. The Partner engages CabinetCare as its exclusive 90-day aftercare and review provider for enrolled kitchens.
7. Insurance & Liability. CabinetCare holds public liability insurance and is responsible for its technicians’ negligence within policy limits; not for pre-existing defects or the Partner’s workmanship. Consumer guarantees under the ACL are not excluded.
8. Independent Contractor. CabinetCare acts as an independent contractor; no partnership, agency or employment is created.
9. Customer Data & Privacy. Handled under the Privacy Act 1988 (Cth); used only to deliver the Services, reporting, and the clause 10 marketing activities where consent is obtained.
10. Photography, Content & Marketing. CabinetCare may photograph the kitchen and create/publish marketing content featuring it. Homeowner consent is obtained before publishing identifiable content; none is published if consent is not given or is withdrawn. No contact details or precise address are published without separate consent. CabinetCare owns the content and licenses it back to the Partner (non-exclusive, royalty-free, attribution retained). Content credits the Partner where practicable. The Partner authorises review invitations to homeowners on its Google review page and will not offer incentives for reviews.
11. Confidentiality. Each party keeps the other’s non-public information confidential (excluding clause 10 marketing content).
12. Disputes. Good-faith discussion within 14 days; then any remedy at law.
13. Governing Law. New South Wales, Australia.
14. General & Acceptance. Entire agreement; amendments in writing. 14.1 Electronic acceptance via this portal (confirming, naming the person accepting, and signing) has the same effect as a signature; CabinetCare’s record of name, date and time is evidence of it.
